Mediation or mediated conflict resolution can be a good alternative to legal proceedings or to a judicial verdict: the professional, impartial mediator can help explore all aspects of the conflict situation, so that both parties feel heard and validated in the process. Once conflicting views are expressed and heard, there may be room for discovering mutual interests and for experimenting with creative negotation towards optimal solutions, that satisfy both parties and safeguard or even strengthen their relationship. Parties in dispute often get entangled in a power struggle with highly opposed positions: any way forward blocked or out of sight... The professional mediator does not impose solutions, but assists parties in exploring the difficulties fully and freely, without pressure and in complete confidentiality, aiming for them to arrive at the best personal solutions. This is different from a conflict in which a judge pronounces a verdict or each party's lawyers/solicitors negotiate, because then most often individuals remain dissatisfied - neither feeling they have truly won. Mediation offers the following advantages:
An important pre-condition is that both parties are willing to try find a solution to their problem and are competent to act and engage in the mediation process.
